GENERAL: This document and related
policies may change without notice and will be updated on a regular
basis. Dial-Up PPP accounts are used on an 'as needed' basis, meaning
they are used only when needed and in no way are intended to be
operating 24 hours a day as an ongoing connection. The account may
be accessed as little or as much as a customer needs, however Nation
Internet has strict definitions of how the service is used.
PPP accounts cannot be
used as a commercial avenue or connection for a dedicated server
site to the Internet.
PPP accounts cannot be
accessed simultaneously by multiple users using the same username.
Dial-Up PPP accounts
do not support a static IP address.
Nation Internet's Dial-Up
Accounts are provided on an "as is, as available" basis.
Nation Internet will not be responsible for any loss either as
a result of using the service or inability to access the service.
The benefits of, or rights
conferred by, these Terms and Conditions are nontransferable.
Use of Nation Internet's service is expressly limited to the person
whose name and signature appear on the account.
The Internet
hosts some material deemed unfit for viewing and reading by minors
under the age of 18. Some sites contain information both in text
and graphical formats that may be considered obscene or harmful.
Customers and subscribers of Nation Internet's services will not
hold Nation Internet responsible for sites and postings which could
be considered obscene, lewd, offensive and/or harmful. It is Nation
Internet policy that individuals are responsible for their own monitoring
and viewing habits and those minors in their care. We currently
do not filter or screen postings or sites on the Internet as a whole
nor do we plan to in the foreseeable future. Customers and subscribers
possibly offended by such material are encouraged to explore software
options that block or filter sites that may be deemed unsuitable.
Abuse of any of these Terms and Conditions may result in a customer
having their account disabled or terminated. Electronic means of
auditing a suspected abused connection will be done by Nation Internet
with respect for the customer's privacy. Continued abuse or violations
of these Terms and Conditions will result in a customer's account
being permanently disabled and all previous agreements rendered
null and void. Nothing contained in this policy shall be construed
to limit Nation Internet's actions or remedies in any way. Nation
Internet reserves the right to take any and all actions it may deem
appropriate under any circumstance.
REFUND POLICY: No refunds given after initial 30 days of
service on prepaid access or monthly access. NO EXCEPTIONS.
NEW CUSTOMER SALES SPECIAL POLICY: Nation Internet new customer specials are
limited to one offer per household (address and telephone number).
Customers found violating this policy will be disconnected immediately
and will not receive a refund of any kind.
LONG-DISTANCE
RESPONSIBILITY POLICY: Nation
Internet is in no way responsible for reimbursing customers long
distance phone charges incurred by the access or installation of
our service. We ask that the customer check with their local phone
carrier to make sure the phone number being dialed is a local call.
INACTIVITY
AND DISCONNECT POLICY: Nation
Internet reserves the right to time-out a customer's connection
after 20 minutes of inactivity or after 6
hours of continuous use. (If you are disconnected because
of a time-out, simply log-on again. Customers who continuously remain
logged on for 12 hours or more, will receive warnings to refrain
from this activity.) These times are general and are subject to
change. Dialup Unlimited Access customers are not permitted to operate
Information Services of any type. Customers wishing to operate information
services of any type are encouraged to contact the Commercial Sales
Department to establish a Commercial Dedicated Account. Customers
who operate servers will receive warnings to refrain from such activity.
Disregard for these warnings may result in termination of the customer's
account.
Electronic
or mechanical means to avoid an inactivity disconnect are strictly
prohibited. Electronic or mechanical means include, but are not
limited to; pinging an Internet server; electronic or software autodialer
features to maintain an active connection; repetitive checks for
e-mail by autologin to the mail server.
ACCEPTABLE
USE OF NATION INTERNET MAIL SERVERS: Nation
Internet expressly forbids all forms of mail server abuse. This
includes, but is not limited to:
Excessive
POP sessions - Customers are asked to check for mail at intervals
no shorter than every ten minutes. This can be set in your email
client.
Excessive Mail Storage
- Customers are asked not to store email on our server. Instead,
customers should configure their email client to delete messages
once they have been read.
CUSTOMERS
SHALL BE PRECLUDED FROM DOING ANY OF THE FOLLOWING:
Posting or transmitting
any transmissions constituting or encouraging conduct which is
a criminal offense, giving rise to civil liability, or otherwise
violating any local, state, national or international law,including
without limitation the U.S. Export control laws and regulations;
Posting or transmitting
any information or software which contains a virus, worm, cancelbot
or other harmful component; Uploading, posting, publishing, transmitting,
reproducing, distributing or participating in the transfer or
sale, or in any way exploiting any information, software or other
material obtained through the Internet which is protected by copyright
or other proprietary right or derivative which is protected by
copyright or other proprietary right or derivative works with
respect thereto, without obtaining permission of the copyright
owner or rightholder
SPAMMING: It is against Nation Internet
policy for any user of any Nation Internet service to effect or
participate in any of the following activities:
To
post a single article or advertisement to more than ten (10) Usenet
or other newsgroups, forums, email mailing lists or other similar
groups or lists;
To
post to any Usenet or other newsgroup, forum, email mailing list
or other similar group or list articles which are off-topic according
to the charter or other owner-published FAQ or description of
the group or list;
To
send unsolicited mass e-mailings. Nation Internet reserves the
right to determine what constitutes a mass mailing.
To
engage in any of the foregoing activities using the service of
another provider, but channeling such activities through an Nation
Internet account or remailer, or using an Nation Internet account
as a maildrop for responses;
To
falsify user information provided to Nation Internet or to other
users of the service in connection with use of an Nation Internet
service.
In addition, Nation Internet reserves the
right, where feasible, to implement technical mechanisms which block
multiple postings as described above before they are forwarded. This
policy addresses only the kinds of network abuse specifically enumerated
above. In addition to these activities, Nation Internet's terms and
conditions of service also prohibit other forms of abuse such as harassment
and the posting of illegal or unlawful materials, and Nation Internet
will respond as appropriate to these other activities as well. Nation
Internet will in no way be held liable for any damaged caused to a
customers computer, their data, or any other damages whether hardware,
software, time lost, or anything else. By using our service, you are
doing so at your own risk & you agree to these terms.
